1o.- Marco Legal
En cumplimiento de la normativa vigente, la entidad POSADA TORCAL S.L. que opera a través de Internet desde este sitio web www.posadatorcal.com detalla a continuación las condiciones generales de contratación de los servicios ofrecidos a través de la misma y de las que se derivan los derechos y obligaciones de las partes.
2o.- Identificación
Las presentes Condiciones Generales de Contratación (en adelante "Condiciones") tienen por objeto regular la relación entre POSADA TORCAL S.L. (en adelante el "Prestador") y los clientes (en adelante el "Usuario"), en relación con todas las transacciones realizadas a través del sitio web en el momento de la reserva.

2O.2.- EL USUARIO
Se entiende por usuario o cliente, el usuario que adquiere esta condición, mediante su registro en el sitio web, a través de un formulario, sobre el que tiene plena responsabilidad de uso y custodia, siendo responsable de la veracidad de los datos personales facilitados al prestador, como veremos en el apartado de Registro de Usuarios.
3ª.- Aceptación
Al aceptar estos Términos, el Usuario declara:
1. Que es una persona con capacidad para contratar según la normativa vigente.
2. Ha leído y acepta estos Términos.
4.- Disponibilidad
El usuario siempre tendrá acceso, antes del inicio del procedimiento de contratación, a las condiciones, y podrá ser almacenado y/o reproducido en un soporte duradero.
5.- Validez o Duración
El período de validez o duración de las presentes Condiciones Particulares y Condiciones de Contratación, será el tiempo que permanezcan publicadas en el citado sitio web y serán de aplicación desde el momento en que el Usuario haga uso del sitio web, y/o proceda a la reserva o a la contratación.
6.- Modificaciones
El proveedor se reserva el derecho de modificar unilateralmente estas Condiciones, sin que ello afecte a los servicios o promociones adquiridos con anterioridad a la modificación por parte del Usuario.
El Usuario se compromete a leer atentamente las condiciones de contratación, cada vez que proceda a una reserva ya que han sido objeto de modificación desde la última vez que accedió.
7.- Nulidad
Si alguna cláusula incluida en las presentes Condiciones es declarada total o parcialmente nula o ineficaz, tal nulidad afectará únicamente a dicha disposición o a la parte de la misma que resulte nula o ineficaz, subsistiendo en todo lo demás las Condiciones.
8.- Objeto del contrato
La finalidad de este contrato es regular la relación contractual de venta que nace entre el proveedor y el usuario en el momento en que este último acepta la compra durante el proceso de contratación en línea a través de los mecanismos que se exponen a continuación.
La relación contractual de venta supone la prestación de servicios/entrega, a cambio de un precio determinado y expuesto públicamente a través del sitio web, de uno o más servicios específicos.
Cada uno de estos servicios podrá ser objeto de una regulación específica mediante las condiciones particulares de contratación de cada uno de ellos.
9.- Registro de Usuarios
El usuario puede realizar la compra de servicios a través de la página web, en el botón superior derecho "Reserva ahora" y "Reserva tu habitación" o en la página de inicio "Reserva tu cena o almuerzo".
10.- Ámbito geográfico
Este sitio web opera y vende en todo el mundo. A partir de entonces, esta zona geográfica se entenderá como "el Territorio". El uso de esta página web así como cualquier compra realizada en ella se considera que ha sido entregada en España, y por lo tanto está sujeta a las leyes y regulaciones españolas vigentes. El Proveedor no acepta ni entrega pedidos fuera de dicho Territorio.
11.- Confirmación de la reserva.
Finalmente, y una vez realizada correctamente la reserva, recibirá un correo electrónico de confirmación de reserva con los detalles de la misma y la referencia de la transacción.
En el momento del check-out, después de la estancia, el proveedor da la opción de solicitar la factura, en la cual, se solicitan los datos fiscales, se entregará una factura en el momento del check-out.
Para confirmar la reserva e iniciar el proceso de pago debe leer y aceptar las condiciones de uso y la política de privacidad.
12.- Procedimiento de cancelación.
Las cancelaciones de reservas individuales (no de grupo) realizadas directamente con el proveedor son gratuitas hasta 48 horas antes de la llegada. Después de eso el 100% de la reserva puede ser cobrada al usuario por el proveedor.
13. - Pagos.
El usuario puede pagar con JCB, Mastercard, Maestro, Visa o en efectivo.
Para validar la tarjeta de crédito, el usuario podrá comprobar y garantizar la reserva y cargar una pequeña cantidad. Este procedimiento estándar es sólo para comprobar. La cantidad cargada será liberada de nuevo.
Con la tarjeta de crédito/débito, se facilitará, entre otros:
i. el número de la tarjeta;
ii. CVV/CVC;
iii. fecha de vencimiento de la tarjeta;
Una vez que haya validado toda la información sobre su reserva, aparecerá una opción para elegir el método de pago que desea utilizar e introducir sus datos.
14.- Registro de entrada y salida.
Registro de entrada: de 15:00 a 21:00
Check-out: de 09:30 a 11:00
15.- Niños en el alojamiento.
El usuario aconseja encarecidamente no traer niños pequeños al alojamiento, ya que éste es menos adecuado y está adaptado a niños menores de 16 años.
16.- Aparcamiento.
El aparcamiento privado es gratuito. El usuario puede aparcar en el alojamiento. No es necesario reservar una plaza de aparcamiento.
17º. Mascotas.
No se permite traer mascotas.
18.- Restricción de edad.
La edad mínima para registrarse y por lo tanto pagar es de 18 años.
19.- Internet.
Internet está disponible en el lugar y es gratuito.
20.- General.
1. No se puede fumar dentro de todo el alojamiento.

21.- Identificación.
El usuario está obligado a presentar una identificación válida al registrarse. El proveedor informará de los datos del usuario a la Guardia Civil (obligatorio) y guardará una copia para sus registros.
Además, puede indicar cómo nos ha conocido marcando una de las posibilidades. A través de un amigo, de las redes sociales, de la publicidad en prensa u otros.
22.- Impuesto sobre el valor añadido.
De acuerdo con la normativa vigente, todo pago realizado al momento de la salida estará sujeto al Impuesto sobre el Valor Añadido (IVA). Actualmente el 10%.
Los datos de su tarjeta no serán almacenados en nuestra base de datos, ya que cuando se rellenen estarán en la web segura del banco elegido. Los datos de su tarjeta están protegidos en todo momento gracias a los servidores seguros de los bancos que utilizan la encriptación SSL en sus comunicaciones.

23.- Disposiciones generales sobre el proceso de pago
- La orden de pago dada por el Usuario implica necesariamente la adhesión a estas Condiciones Generales así como a las condiciones particulares de la reserva.
- Para cualquier forma de pago elegida por el Usuario, todos los pagos estarán sujetos a los términos y condiciones aplicables al Usuario por las instituciones financieras involucradas o por las plataformas de pago de forma segura (por ejemplo, Visa, Mastercard, etc.).
El Proveedor se reserva el derecho de cancelar los pagos o las reservas en caso de que haya pruebas de transacciones fraudulentas, dando a conocer a las autoridades competentes la conducta que probablemente se investigará para la prevención del fraude.
24.- Servicio de Atención al Cliente: Ayuda, Sugerencias y Reclamaciones

25.- Limitación de responsabilidad
Toda la información proporcionada por el Usuario al Proveedor y a través de los formularios correspondientes debe ser veraz. Es responsabilidad del Usuario mantener debidamente actualizados los datos facilitados al Prestador. En cualquier caso, el Prestador declina cualquier responsabilidad por los daños y perjuicios causados como consecuencia de haber facilitado información falsa, insuficiente, inexacta o incorrecta.
El acceso al sitio web no implica obligación alguna por parte del Prestador de comprobar la autenticidad, idoneidad, exhaustividad, exactitud, adecuación y actualización de la información facilitada por el Usuario a través de los formularios correspondientes.
El Prestador no será responsable en los casos en que corresponda a los padres, tutores o representantes legales de los Usuarios menores de edad o discapacitados, autorizar el acceso, el suministro de información personal o el uso del sitio web o la contratación de cualesquiera productos o servicios prestados a través de las aplicaciones o la plataforma web. Será responsabilidad de los mencionados padres, tutores o representantes legales supervisar el acceso y uso del menor o discapacitado a la contratación de los servicios prestados a través de www.posadatorcal.com
El acceso de los usuarios a los Contenidos no implica ninguna obligación por parte del Prestador de controlar la ausencia de virus o de elementos informáticos que puedan tener efectos perjudiciales en el equipo informático del usuario. En cualquier caso, corresponderá al Usuario disponer de las herramientas necesarias para detectar dichos virus o elementos informáticos de carácter nocivo. En consecuencia, el proveedor no se hace responsable de los daños ocasionados en el equipo informático de los Usuarios o de terceros durante el acceso a los Contenidos.
El prestador no se hace responsable de las interrupciones de los servicios eléctricos o de telecomunicaciones que impidan a los usuarios utilizar los servicios ofrecidos.
26.- Ley aplicable y jurisdicción
Estas condiciones se regirán o interpretarán de acuerdo con la legislación española en lo que no esté expresamente establecido. El prestador y el usuario se comprometen a someter cualquier controversia que pudiera derivarse de la prestación de los productos o servicios objeto de estas condiciones, a los Juzgados y Tribunales del domicilio del usuario.
En el supuesto de que el usuario tenga su domicilio fuera de España, el prestador y el usuario, con renuncia expresa a cualquier otro fuero, se someten al de los Juzgados y Tribunales del domicilio del PROPIETARIO DE LA WEB.

2O.2.- THE USER
It means the user or customer, the user who acquires this condition, through his registration on the website, using a form, on which he has full responsibility for use and custody, being responsible for the veracity of the personal data provided to the provider, as we will see in the section of User Registration.

6th.- Modifications
The provider reserves the right to unilaterally modify these Terms, without affecting the services or promotions that were acquired prior to the modification by the User.
The User undertakes to read carefully the conditions of contract, each time he proceeds to book or reserve since they have been subject to modification since the last time he/she accessed.
7th.- Nullity
If any clause included in these Terms is declared wholly or partially void or ineffective, such nullity will affect only that provision or the part thereof that is null or ineffective, subsisting in everything else the Terms.
8th.- Subject of the contract
The purpose of this contract is to regulate the contractual relationship of sale born between the provider and the user at the time when the latter accepts the purchase during the online contracting process through the mechanisms set out below.
The contractual relationship of sale entails the services/ delivery, in exchange for a certain price and publicly exposed through the website, of one or more specific services.
Each of these services may be subject to specific regulation by means of the particular conditions of contracting each of them.
9th.- User Registration
The User may carry out the purchase of services through the website, in the upper right button "Book now" button and "Book your room" or on the Home page "Book your dinner or lunch".
10th.- Geographical scope
This website operates and sells worldwide. Thereafter, this geographical area shall be understood as "the Territory". The use of this website as well as any purchase made on it is considered to have been delivered in Spain, and therefore subject to the Spanish laws and regulations in force. The Provider does not accept or deliver orders outside the aforementioned Territory.
11th.- Booking confirmation.
Finally, and once the booking has been made correctly, you will receive a reservation confirmation email with the details of the same and the reference of the transaction.
Upon check-out after staying with us, provider gives the option to request the invoice, in which, the tax data is requested, an invoice will be handed out at check-out.
To confirm the reservation and start the payment process you have to read and accept the terms of use and privacy policy.
12th.- Cancellation procedure.
Cancellations for individual (not group) bookings made directly with provider are free of charge until 48 hours before arrival. After that 100% of the booking may be charged to user by provider.
13th.- Payments.

14th.- Check-in and check-out.
Check-in: from 15:00 to 21:00
Check-out: from 09:30 to 11:00
15th.- Children at the accommodation.
Provider strongly advises against bringing young children to the accommodation since the accommodation is less suitable and adjusted to children younger than 16 years.
16th.- Parking.
Private parking is free. User can park at the accommodation. No need to reserve a parking space.
17th. Pets.
Bringing pets is not allowed.
18th.- Age restriction.
The minimum age for check-out and thus payment is 18.
19th.- Internet.
Internet is available at the location and is free of charge.
20th.- General.
- Non-smoking inside the entire accommodation.

- Aircondioning and heating depending on season.
- Smoke-free rooms.
- Safety deposit boxes are provided.
- Maximum occupancy per room is 2 people.
21th.- Identification
User is obliged to present a valid identification upon check-in. Provider will report the user's details to the Guardia Civil (mandatory) and keep a copy for its records.

22nd.- Value added tax
In accordance with current regulations, any payment made upon check-out will be subject to Value Added Tax (VAT). Currently 10%.

23rd.- General Provisions on the Payment Process
- The payment order given by the User necessarily implies adherence to these General Conditions as well as the particular conditions of the booking.
- For any form of payment chosen by the User, all payments will be subject to the terms and conditions applicable to the User by the financial institutions involved or by the payment platforms securely (e.g. Visa, Mastercard, etc.).
Provider reserves the right to cancel payments or bookings in the event of evidence of fraudulent transactions by making known to the competent authorities the conduct that is likely to be investigated for the prevention of fraud.
24th.- Customer Service: Help, Suggestions and Complaints

25th.- Limitation of liability
All information provided by the User to the Provider and through the corresponding forms must be truthful. It is the User's responsibility to keep the data provided, to the Provider, duly updated. In any case, the Provider disclaims any liability for damages caused as a result of having provided false, insufficient, inaccurate or incorrect information.
Access to the website does not imply any obligation on the part of the Provider to verify the authenticity, suitability, completeness, accuracy, adequacy and updating of the information provided by the User through the corresponding forms.
The Provider shall not be liable in cases where it corresponds to the parents, guardians or legal representatives of minor or disabled Users, authorize access, provision of personal information or use of the website or the contracting of any products or services provided through the applications or web platform. It will be the responsibility of the aforementioned parents, guardians or legal representatives to supervise the access and use of the minor or disabled to the contracting of the services provided through www.posadatorcal.com
Users' access to the Contents does not imply any obligation on the part of the Provider to control the absence of viruses or computer elements that may have any harmful effect on the User's computer equipment. 26th.- Applicable Law and Jurisdiction
These conditions shall be governed by or construed in accordance with Spanish law in matters not expressly established. The provider and the user agree to submit any dispute that may arise from the provision of the products or services subject to these conditions, to the Courts and Tribunals of the user's domicile.
In the event that the user is domiciled outside Spain, the provider and the user expressly waive any other forum, submitting to the Courts and Tribunals of the domicile of the OWNER OF THE WEB.
